Elenis case. The 6-3 decision affirms that the Free Speech Clause of the First Amendment allows businesses to discriminate against LGBTQ+ customers when providing custom goods and services. As Justice Sotomayor dissented, "Today, the Court, for the first time in its history, grants a business open to the public a constitutional right to refuse to serve members of a protected class." This unprecedented decision will have a harmful impact on the LGBTQ+ community –– it’s dangerous and outrageous, especially during a year where the LGBTQ+ community is in a state of emergency. We are continuing to track and fight back against a record number of anti-equality bills from all levels of the government — all determined to destroy our progress and erase us from public life and the history books. But we will not allow this radical Court to dismantle LGBTQ+ rights.
