But this week, the Court will be turning that spotlight right back around as it hears arguments on [two landmark cases]( related to social media content moderation. In 2021, the states of Florida and Texas each passed “anti-censorship” bills, written in response to what their state legislatures see as unfair tech company practices for banning individual users and the content they’ve posted. The bills each require social platforms to, among other things, publish their moderation criteria and apply them consistently. Industry groups representing the platforms soon filed lawsuits against both states on the grounds that their bills violated the tech companies’ First Amendment rights. They contend that this legislation would set a dangerous precedent around government intervention in a media marketplace built on the free exchange of ideas. After a series of injunctions and appeals court rulings, it’s now up to SCOTUS to decide whether either of these laws will stand. It's a complicated question with potentially troubling implications. Some experts say it could lead to the end of social media moderation and [threaten the enforcement of anti-discrimination and child protection laws.]( Participation on social platforms always carries some [risk for brands]( and the SCOTUS decision (no matter which way it goes) doesn't change that. Whether you believe in content moderation (we do) or not, the future of social media will be shaped by the court’s decision.
