The IRS loves to demand paperwork for everything. And it all needs to be filled out and signed correctly… or else. But what happens when the IRS fails to file its own paperwork correctly? Or worse, what happens when the IRS backdates a document and lies about it to a court? So far, nothing… But growing pressure may change that. That’s why I’m emailing you today. I am Al Canata, Vice President of Strategic Partnerships at the National Taxpayers Union Foundation (NTUF). Please click below to show your support.]( [Donate >>]( All of this has to do with a requirement put in place by the Internal Revenue Service Restructuring and Reform Act of 1998 (the direct result of important work led by NTU in highlighting IRS enforcement abuses and the need for reforms) which requires an IRS supervisor to review and approve, with their signature, any imposition of tax penalties. Simply put, no supervisor signature, no penalties. But it turns out that the IRS wasn’t following this requirement. The Lakepoint Land Group uncovered evidence that the IRS backdated the supervisor’s signature and then obstructed attempts to find out when the supervisor even signed the document. Lakepoint then filed a lawsuit when the IRS dragged its feet on the Freedom of Information Act request for documents related to the incident. This is just one example of the IRS applying a double standard, giving themselves an advantage over taxpayers at every turn. But as more revelations like this appear in courts, the easier it is for the Taxpayer Defense Center to identify and engage in the cases that are the most likely to have a positive and lasting impact on taxpayers’ rights. NTUF launched the Taxpayer Defense Center in 2020, and since then, we’ve already made a powerful impact in these cases: - In Boechler v. Commissioner, NTUF’s amicus brief in support of Boechler elicited a very rare response from the United States solicitor general. We argued that tax collection would not be severely harmed if the IRS’s unrealistic position was struck down. The Supreme Court would rule 9-0 against the IRS. - In Oakbrook Holdings v. Commissioner, the Center was the only public interest litigation group filing a brief in this Sixth Circuit case involving the IRS. Our brief argued that the IRS’s shifting position on regulations had put taxpayers who wanted to follow the law in an impossible situation. We have laid the groundwork for future challenges to the government’s contradictory behavior. - And in CIC Services v. Internal Revenue Service, the IRS has long hidden behind the Anti-Injunction Act to prevent taxpayers from taking the tax agency to court. In this case, the unanimous Supreme Court decision said that there are limits to the IRS’s defense, opening the door to more challenges from taxpayers. We filed in support of the plaintiff’s position in that case, which was also decided on a 9-0 ruling against the IRS.
