Police questioned the 24-year-old man who put Neely in the chokehold but have not identified him, and the medical examiner ruled Neely's death a homicide. A witness who shot video of the incident said Neely, a subway busker who was homeless and struggling with mental illness, was acting aggressively when he got on the train car, telling passengers he was hungry, thirsty and didn't care about going to jail. "It would be incredible to me if the outcome of this would be no charge, because how can you say that it’s okay for someone to strangle someone?" a lawyer for Neely's family told NBC News. Protesters outside the district attorney's office demanded criminal charges for the man who applied the chokehold. [Here's the latest](.
