The Hindu has exclusively accessed papers filed by the U.S. government in India's extradition appeal for [26/11 terror attack]( accused Tahawwur Rana. These papers, filed in a California court ahead of the extradition hearing in February 2021, detail the communication between Rana and [David Headley, another prime accused]( in the case who is currently in jail in the U.S. The communications intercepted by the FBI in 2009 has [Pakistani-Canadian citizen Rana]( asserting his role in the terror attack and supporting it as "the Indians deserved it". Rana, who was a businessman in Chicago, has been in jail since his arrest in 2009. His sentence, which was to be completed in September 2021, was commuted in June this year after he contracted[COVID-19](. He was [rearrested by U.S. authorities over India's extradition request.]( Headley had used the immigration business of Rana, his schoolmate from Pakistan, as a cover to carry out extensive surveillance in Mumbai ahead of the 26/11 attacks in 2008. The documents show that Rana was conspiring for further attacks in India and elsewhere with Headley in 2009. Also, Rana had been in direct communication with some of Headley's contacts in Pakistan. Headley, who is serving out a 35-year sentence, cannot be extradited to India due to the nature of the plea bargain he made with U.S. authorities and the legal concept of double jeopardy, under which a person cannot be punished for the same crime twice. However, the U.S. government has supported India's extradition request for Rana, and opposed his argument that he can get the same cover that prevents Headley's extradition. This argument of the U.S government, and the details of the amount of planning that went into the 26/11 attacks that come out in the documents, are what make the story important.
