The decision did come down in favor of the baker – which surprised even some of his backers, who didn’t know how strong the case would be – but it did so because the Colorado commission that decided against him was so clearly anti-religious in their statements, which they declined to disavow before the court. That sets up future fights over commissions and agencies which are more careful with their words when it comes to related religious objections to providing services.
