In a court order dated August 31, 2022, Justice MJ Dolamo also ordered that investors must submit their claims from the [doomed bitcoin investment](=.uBA3FElIl7gN1aoo5YkyGmWQEVMjsOYZzu8GYSfK5rY) scheme in rand value. Backstory: South African Cornelius Johannes Steynberg, through MTI, [created and operated](=.TQaQXO5Kkz7-VynxjL1kv-e6O3WB8bf-QSUeiArNapc) a bitcoin fraud scheme that robbed people of $1.7 billion. In March 2021, the liquidators [recovered](=.QVBaC51qRstUT4R2EAi4wDJqIE0fTVFrtPYkm2uWEzY) 1,281 bitcoin worth R1.1 billion frozen by MTI’s former brokerage in Belize, FXChoice. Back to the court order According to the court order, Justice Dolamo considered two scenarios and separated MTI investors into three classes. The two scenarios were one where MTI was considered a pyramid scheme and the other where MTI investor agreements were not voided and the investors hence became creditors. The 3 classes into which MTI investors were separated were Class 1 (investors who received zero returns), Class 2 (investors who received returns but did not profit from the scheme), and Class 3 (investors who profited from the scheme). According to MyBroadband, in the first scenario, the court directed the liquidators to accept class 1 investors’ proven rand-based claims. Meanwhile, Class 2 investors must subtract their returns from their initial investments to determine their claims, while Class 3 investors will initially have no claim, and liquidators may go after them to recover profits. For the second scenario, the court order stated that liquidators should pursue the Class 2 investors in respect of their returns, and the Class 3 Investors in respect of their initial investments and their profits. It might all be for nothing, though In July this year, the South African Revenue Services (SARS) [lodged a claim](=.WVJvSx_DWP3tnOj09FMoZUCTguoAE7XzDrXDJtHSQJk) for over R931 million in taxes and penalties against the estate of Mirror Trading International. If collected, the tax would consume nearly all of the money the scheme’s liquidators have recovered, leaving little for the victims of MTI’s scheme.
