Their motion states: "The Constitution, the Supreme Court, and hundreds of years of history and tradition all make clear, the President’s motivations are not for the prosecution or this Court to decide." This 22-page filing was submitted ahead of a scheduled hearing on October 16th at the federal district court in Washington, as reported by The Guardian. Former Prosecutor and Missouri Attorney General Candidate Will Scharf weighed in on the motion, stating, "The motion persuasively argues that the D.C. case should be dismissed, and if past practice is any guide all proceedings could and should be stayed while this issue is litigated fully. Notably, this same reasoning should apply to the ongoing Georgia prosecution as well." Scharf's analysis simplifies the argument: In assessing presidential immunity, the motive of a president is irrelevant. What matters is what the president did and whether it fell within the broad scope of their official responsibilities. Trump's alleged acts, such as making public statements about the 2020 federal election, communicating with public officials, and taking steps related to alternate slates of electors, all fall within the perimeter of his official duties. Intent, accuracy, and legality of these acts are immaterial when determining immunity. The relevant question is whether these actions were within the President's role to "take care" of the execution of American election laws, including the Voting Rights Act of 1965 and the Electoral Count Act of 1887. Regardless of personal opinions or views on these actions, the answer is yes. Therefore, both the motion and Scharf argue that since the indictment is based on acts that the President is immune from prosecution for, the case should be dismissed. Whether these actions were appropriate or lawful is irrelevant, and impeachment is the constitutional remedy for such matters, which has already occurred without conviction. The key issue is whether the actions fell within the President's official responsibilities.
