This week, the California legislature passed a bill that addresses parental affirmation of their child's gender identity. Assembly Bill 957, also known as the Transgender, Gender-Diverse, and Intersex Youth Empowerment Act, received approval from the California Assembly on Friday with a 57-16 vote, primarily along party lines. The state senate had previously passed the bill on Wednesday with a 30-9 vote. The state senate had previously passed the bill on Wednesday with a 30-9 vote. The legislation seeks to incorporate a parent's affirmation of their child's gender identity as a component of the child's overall health, safety, and welfare. Should Governor Gavin Newsom (D) endorse the bill, it would require judges overseeing custody cases to take into account a parent's "affirmation" of their child's gender identity when assessing the child's well-being and safety as part of their decision-making process. As the Daily Signal reported: Threatening the standard of “health, safety, and welfare” of a child under the California Family Code can carry penalties under the California Penal Code—prompting parents, activists, and lawmakers to speculate that AB 957 could result in parents being charged with child abuse or neglect for not participating in a child’s transgenderism. During a hearing on the bill, California Senator Scott Wilk (R) expressed concerns that the legislation might compel parents to leave the state. He remarked, "In recent years, we have seen government intervention between parents, children, and medical care decisions. Now, with this bill, if a parent doesn't align with the government's ideology, their children may be removed from their homes. If you care about your children, you may have to consider leaving California." The bill's sponsor, Assemblywoman Lori D. Wilson, explained that her motivation for pursuing this legislation stemmed from her own experience as the mother of a transgender son. She emphasized the critical importance of family acceptance in the well-being of LGBTQ+ youth, citing research that highlights how such acceptance serves as a vital protective factor against depression and substance abuse. Wilson stressed that comprehensive social support from friends and family members is strongly associated with positive mental development, physical health, and overall well-being.
