Going into the hearing Tuesday with special counsel Robert Hur... Going into the Tuesday with specia

Going into the hearing Tuesday with special counsel Robert Hur... Going into the [hearing]( Tuesday with special counsel Robert Hur, appointed by AG Merrick Garland to investigate Joe Biden’s mishandling of classified documents, Democratic lawmakers had two goals: the first was to spin Hur's report to show that Biden had been forever "exonerated" of any charges; the second was to show that Biden is in fact not a senile man with serious memory problems but a mentally sharp albeit old leader who occasionally misspeaks. [They ended up failing at both](. Read on to find out why! In This Week's Newsletter ... - Real Big News: Robert Hur slams Democrats - Hot Off The Press: Congress moves to ban TikTok - For The Record: Liberal pundits: Trump is winning Everything we do is made possible by our faithful subscribers. If you love reading the Daily Caller, [please consider joining us today.]( [JOIN US!]( REAL BIG NEWS Democrats Attempt Biden Damage Control At Hur Hearing — It Backfires Massively Seated before Congress on Tuesday, Hur spent nearly five hours outlining his February report, taking heat from both Democrats and Republicans, including Florida Rep. Matt Gaetz. The special counsel's report concluded that charges should not be brought against President Joe Biden, in spite of the president willfully withholding classified documents. Following the report's release, the White House went into spin mode, denouncing notes on the president's mental state as "flatly wrong" and "politically motivated." Democratic lawmakers spent quite some time lashing out at former President Donald Trump, however, when they did get around to the report, they [hit]( Hur on his personal political affiliation. Leading up to the hearing, Biden allies had repeatedly smeared Hur as "MAGA," even though Democrats previously [praised]( the special counsel for his professionalism. Democratic Georgia Rep. Hank Johnson baselessly [accused]( him of doing everything he could during his investigation to re-elect former President Trump. “Despite clearing President Biden from being prosecuted, you used your report to trash and smear President Biden because he said in response to questions over a five-hour interview that he didn’t recall how he got the documents, and you knew that would play into the Republicans’ narrative that the president is unfit for office because he’s senile," Johnson said. "And the American people saw during the State of the Union address that that was not true. and yet that is what you tried to offer to them and that’s why they are having you here today. So that they could expand on that narrative. And you knew that was what was going to happen, didn’t you?” As Hur started to answer, Johnson cut him off and asked if he was a member of the Federalist Society and a registered Republican. The special counsel denied being a part of the Federalist Society but noted that he is a registered Republican. There were two more key moments during the hearing that undercut the Democrats' and White House's efforts to downplay the report ahead of the 2024 election. During his testimony, Hur [confirmed]( that the White House attempted to persuade the special counsel to water down parts of his report that critiqued the president's memory. Hours before the hearing, the transcript of Biden and Hur's interview was leaked. The most crucial moment of the hearing occurred when Hur set the record straight on the conclusion of his report. “This lengthy, expensive and independent investigation resulted in a complete exoneration of President Joe Biden,” Democratic Washington Rep. Pramila Jayapal began. “For every document you discussed in your report, you found insufficient evidence that the president violated any laws about possession or retention of classified materials.” “You exonerated him,” the congresswoman continued as she talked over Hur who contested the wording. “I did not exonerate him,” Hur hit back. “That word does not appear in the report, congresswoman.” HOT OFF THE PRESS TikTok...TikTok...TikTok: A debate among conservatives has exploded into full view after the “Protecting Americans From Foreign Adversary Controlled Applications Act,” which would give TikTok's Chinese parent company ByteDance five months to sell the app or face a ban, [passed]( the House with a bipartisan 352-65 vote on Wednesday. 15 [Republicans]( 50 Democrats [voted]( against it. Conservatives Divided! Despite only 15 GOP lawmakers voting against the TikTok bill, conservatives are torn as to whether the legislation hands over too much power to the executive branch, and whether ByteDance's control of the app actually poses a "national security threat." The Daily Caller's own Mary Rooke and Grayson Quay, each holding starkly different views on the issue, lay out the case for and against passing the bill. Rooke holds that the legislation could ultimately pave the way for a president, Republican or Democrat, to use the newly granted power to censor domestic political opponents. Quay, on the other hand, thinks the national security case is "strong," and that TikTok should be banned, if not for CCP espionage than the fact that it is addictive and spreads destructive anti-American ideologies among young people. [From Rooke's piece:]( It is incorrect to compare this to the Patriot Act, as some pundits have done. The bill does not target everyday Americans in the same way the Patriot Act was weaponized here at home. Unlike the Patriot Act, which allowed the federal government to secretly spy on Americans, this is aimed at companies, not individuals, and the evidence must be made public. Still, the Congressional briefing sent by the president would include a "classified annex," presumably made up of information from U.S. intel agencies that would need to be kept hidden from the public for safety purposes. That is, of course, the most gracious view of the reasoning to keep this information private. But that's where Congress's power to curtail the president ends. What, if anything, can Congress do if it disagrees with the president's determination? The short answer is nothing. [Editor Grayson Quay's take:]( The national security case for banning TikTok (or at least forcing its Chinese parent company to [sell it off]( is strong, and I'm glad the profusion of pro-Hamas content finally [convinced]( Democrats that the app might hurt them with young voters. But I wish a few lawmakers had the cojones to stand up and say, "China or no China, we're banning TikTok because it erodes the social fabric of this country. We want our kids to be mentally healthy, not [suicidally depressed]( or afflicted by self-diagnosed [Dissociative Identity Disorder](. We want our kids to read books and pursue meaningful hobbies, not scroll through their phones for hours on end. We want our kids to carry on our values, not despise them. We want our kids comfortable in their bodies, not [brainwashed]( into seeking out chemical castration or surgical mutilation. Trump Scores Big Legal Win: Judge Scott McAfee, the judge overseeing the racketeering case against Donald Trump and his co-defendants in Georgia, handed the former president a big win Wednesday by dismissing six counts of the indictment. McAfee [sided]( with the defendants, writing that the six counts did not "give the Defendants enough information to prepare their defenses intelligently, as the Defendants could have violated the Constitutions and thus the statute in dozens, if not hundreds, of distinct ways." TRENDING What's your take on this? [Click here]( and scroll down to leave a comment! FOR THE RECORD Pundit Panic: Defense attorney Caroline Polisi [told]( MSNBC that President Trump’s election interference case could be over on Wednesday, and that the potential disqualification of Fulton County District Attorney Fani Willis could be the “death knell” of the case. Meanwhile, senior legal analyst Elie Honig at CNN argued that the decision to toss six counts against Trump will definitely hurt District Attorney Fani Willis’ case, slamming the outcome as "[embarrassing]( Corporate Media Exposed: Corporate media outlets and liberal pundits repeatedly defended President Joe Biden's mental fitness leading up to the leak of Robert Hur's report and the subsequent hearing Tuesday, claiming the president was clear-minded throughout the interview. However, the transcript [confirmed]( that the president lied at a recent press conference in which he was defending the report, and showed that Biden himself brought up his late son Beau's death, not Hur, as he had previously claimed.
