We’ve been getting a clearer picture of the story that the special counsel, Jack Smith, plans to tell when he and his prosecutors take Donald Trump to trial next year on federal charges of plotting to overturn the 2020 election. And it’s going to be a long one. Smith has signaled that he wants to show the jury a panoramic view of Trump’s history of lying about election fraud, threatening his adversaries and supporting violent extremists, including members of the far-right group the Proud Boys. From the earliest days of the case, when Trump was charged in Washington in August, it was clear Smith’s team was going to tell a tale that began around Election Day in 2020, continued with backroom machinations over nine chaotic weeks and erupted publicly with the storming of the Capitol by a pro-Trump mob on Jan. 6, 2021. But this week, prosecutors filed court papers suggesting that their narrative will unfold over a much longer time frame, starting well before Trump was even running against Joe Biden and carrying on, more or less, until today. Going back to 2012 Smith and his team seem to have absorbed important lessons from others who have tangled with Trump. They appear to have learned that the former president has used the same handful of moves over and over for decades and often insists that he has been misunderstood or misinterpreted in order to escape being pinned down or held accountable. The antidote for that, they are signaling, is demonstrating a pattern of behavior. To that end, prosecutors are preparing to turn Trump’s frequent complaints about election fraud and his repeated refusals to commit to leaving office against him to show he “sowed mistrust in the presidential election and laid the foundation” for maintaining that he won. Donald Trump outside the New York State Supreme Court in Manhattan on Thursday. Dave Sanders for The New York Times And so prosecutors told the judge that they want jurors to hear about a Twitter message Trump wrote as far back as 2012 in which he claimed voting machines had been hacked to flip votes away from Mitt Romney, the Republican’s presidential candidate, to Barack Obama. There’s also likely to be evidence introduced about social media posts Trump wrote during his 2016 run for office. For example: “Of course there is large scale fraud happening on and before election day. Why do Republican leaders deny what is going on?” Jurors may be told about a number of occasions when Trump dodged when asked if he would step down if defeated. They may even hear about how one of Trump’s campaign aides “encouraged rioting” at a vote counting center in Detroit one day after the election when he learned Biden was winning. At the heart of Jan. 6 The story prosecutors tell at trial is also likely to make Trump a far more central character in the violence at the Capitol than the one told in the original indictment. Prosecutors are planning to tell the jury about how Trump told the Proud Boys to “stand back and stand by” during a debate with Biden in September 2020. They also want to demonstrate how he has promoted the so-called “Jan. 6 Choir” — a group of inmates jailed for attacks against the police on Jan. 6 — at some of his political events. Too explosive Trump’s lawyers will surely push back against allowing much of this to be used at trial. They will no doubt claim that linking Trump to the Proud Boys, for example, is tenuous and prejudicial, and that showing videos of rioters beating up officers is far too explosive to be part of the presentation to jurors, especially since the former president has not explicitly been charged with inciting any of the violence on Jan. 6. No surprise: It’s very different from the prosecution’s. When the defense puts on its case, the jury is likely to hear a lot about the “deep state” and how Trump believed the Democrats had stolen the election from him even though his own intelligence and national security officials, not to mention several lawyers working for him, told him repeatedly that it had been conducted fairly. Trump’s legal team also wants to drag some unrelated matters into their narrative to muddy the waters of the government’s case.
