Almost from the moment that the two cases were filed — the first in Florida, the second in Washington — prosecutors working for the special counsel, Jack Smith, have accused Trump of seeking to delay them, sometimes with legally specious arguments or cynical tactics. Among their fears, which have been palpable but never quite voiced: If the trials are delayed until after the presidential election and Trump wins, he could have the charges dismissed. It is not an unreasonable worry. The former president and some of his closest associates, in private conversations, have been absolutely clear that they see a win in 2024 not just as a vindication after he had to depart the White House, but also as a step toward having his attorney general drop both of the cases he is facing — one in which he stands accused of hoarding classified documents and obstructing efforts to reclaim them, the other on charges of plotting to reverse his 2020 defeat. If Trump succeeds in delaying the trials until after November, it would do more than provide him with an opportunity to wipe out the indictments. It would also mean that voters would go to the polls next year without getting to hear any of the detailed evidence prosecutors have collected. And yet, while there are serious risks in delaying the trials, moving too quickly to bring them to conclusion could also jeopardize the cases, by imperiling the rights enjoyed by Trump as a criminal defendant. As his lawyers have often argued matters as complex as these, involving scores of witnesses and millions of pages of investigative evidence, often take years to go in front of juries. No matter the merit of such claims, there is little doubt that Trump will continue making them as the campaign heats up. Slowing down The tension between speed and fairness flared two weeks ago in the classified documents case in Florida, when Judge Aileen Cannon pushed back several deadlines she had set to resolve disputes over how to handle the highly sensitive materials at the heart of the proceeding. In some ways, this was unsurprising: Most cases involving classified records get bogged down in complex and time-consuming litigation. But Judge Cannon’s decision to slow-walk the process all but ensured that the trial would not begin at the end of May as scheduled. If that were that to happen, Judge Cannon, a Trump appointee who has made some rulings that have favored the former president, might decide to push the proceeding until after the election altogether, hoping to avoid the awkward situation of obliging Trump to be in court when he could be out campaigning. That motion centers on a dubious and untested claim that Trump enjoys “absolute immunity” from the election subversion charges because the indictment is based on official presidential actions he took while he was in office. Judge Tanya Chutkan, who is overseeing the case, is almost certain to deny the motion, but since it involves a constitutional question of whether the charges should have been brought at all, Trump will have the right to an immediate appeal. And that’s where his Hail Mary plans begin. Trump will be able to argue in favor of his immunity claim in front of a three-judge panel of the federal appeals court in Washington and, if he loses there, will likely mount a similar challenge before all nine judges on the court. If he loses again, he could go to the Supreme Court — which may or may not take the case or rule in his favor. Winning isn’t the only point. Either way, he would be eating up time. Trump is hoping his combined appeals push the start of the trial, now scheduled for March, past Election Day, or at least until after the Republican nominating convention in July.
