The setting was his civil fraud trial in Manhattan, where a judge is deciding what penalties he should face for inflating the value of his properties to secure favorable loan terms from banks. It pretty much went as you’d expect. While Trump made some material admissions that could damage his standing in the case, he used his time on the stand mostly to rant against prosecutors and the judge, and to turn his testimony into a political stump speech. ALAN: Why don’t you start by briefly setting the scene for us and let readers know what happened in the courtroom in New York? We understand there were fireworks in terms of conflicts Trump had with people involved in the case but also some important legal developments in terms of his actual testimony. JONAH: Both things are true and occasionally they overlapped. On the stand, Trump’s behavior did not change all that much. He attacked the New York attorney general, Letitia James, calling her a “political hack” and the judge, Arthur Engoron, calling him a “fraud.” He complained a lot about the case to the lawyer questioning him for it, saying it was political and that it demeaned him. And then, yes, he did make admissions that appeared helpful to the attorney general’s case. He said that he would look at the annual financial statements and make suggestions about them. The judge has already found that those statements were filled with fraud, so Trump’s direct involvement with them is not great for his case. JONAH: Well as you often say, Maggie, there is very little daylight between Trump’s legal strategy and his re-election campaign, and that’s been on vivid display throughout this case. He absolutely took his political arguments to the witness stand, and his lawyers let him be himself, echoing his points in interviews during and after the testimony ended. One of them, Christopher Kise, said that in 33 years, he’d never had a witness testify better. I should add that it has been clear from the beginning that Trump’s team does not think he has much of a shot with this judge, and is planning to appeal. We know this is a civil case, not a criminal case, but what sorts of consequences could Trump face in this proceeding? JONAH: A good way to think about it is that while the criminal cases endanger Trump’s future, putting his freedom at risk, this one strikes at the part of his past he holds most dear. His image as a savvy and extremely wealthy real estate developer is core to how he thinks about himself and he’s leveraged it many times, first to become a reality television star and then a political candidate. There are also real-world consequences that could come from this, though they won’t be final for some time: He could be penalized hundreds of millions of dollars and permanently barred from running a business in New York. That’s when we’ll know just how much the Trump family stands to lose, though there’s likely to be a drawn-out process of appeal. That poll A New York Times/Siena College poll this week showed Trump leading President Biden in five of six battleground states a year before the election. It suggested that Trump’s legal troubles are not top of mind for voters. The Jan. 6 case This week, the special counsel leading the federal criminal investigations, Jack Smith, revealed a key part of his strategy in the case accusing Trump of plotting to overturn the 2020 election. In court papers, Smith indicated that he intends to put the assault on the Capitol on Jan. 6, 2021, at the heart of the prosecution and might even try to call witnesses to testify they attacked police officers and breached the building at Trump’s direction. The case is scheduled to go to trial in March. While the indictment in the election case never explicitly charged Trump with inciting the riot, the new court papers squarely placed the blame on his shoulders, calling the attack “the culmination” of his “criminal conspiracies to overturn the legitimate results of the presidential election.” By directly connecting Trump to the violence at the Capitol, Smith has set himself up to use a mountain of testimonial and video evidence collected in the criminal cases of hundreds of rioters. The judge overseeing Trump’s election interference case in Georgia has already said he will televise the trial and many of the hearings have been shown live on video. But viewers have not been — and will not be — able to watch most of the other proceedings, including Trump’s testimony this week in his civil fraud trial in New York.
