Just this week, three developments drove home how inextricably entwined Trump’s legal proceedings are — and always have been — with his political ambitions. Today, the judge in Manhattan who oversaw the hush money trial where Trump was found guilty of 34 counts of business fraud announced in a pained decision that he was going to [hold off sentencing Trump until after Election Day](~/AAAAAQA~/RgRoveyfP0TqaHR0cHM6Ly93d3cubnl0aW1lcy5jb20vMjAyNC8wOS8wNi9ueXJlZ2lvbi90cnVtcC1zZW50ZW5jaW5nLWRlbGF5LXJ1bGluZy5odG1sP2NhbXBhaWduX2lkPTMwNSZlbWM9ZWRpdF90b3RfMjAyNDA5MDYmaW5zdGFuY2VfaWQ9MTMzNjUzJm5sPXRydW1wLW9uLXRyaWFsJnJlZ2lfaWQ9Nzc2NzQ5NTImc2VnbWVudF9pZD0xNzcxMTMmdGU9MSZ1c2VyX2lkPWFhNDkxZWY3ZjFkOTY0ZTQ5NzlmYjc4NGU3NGUwMWQ3VwNueXRCCmbPn2fbZjb9ck1SG3RyaXN0cmFtYmFsZHdpbjkwQGdtYWlsLmNvbVgEAAAAAw~~). That ruling came only a day after a different judge in Washington, the one presiding over the case in which he is charged with plotting to overturn the 2020 election moved modestly in the opposite direction. Although Trump will not be tried on those charges before next year, if he is tried at all, she declared that Trump’s candidacy wasn’t going to stop her from pushing forward with a pretrial proceedings that could result in some new evidence coming out before voters go to the polls. As for Trump himself, he turned up for an appellate hearing in Manhattan where his lawyers sought to reverse the outcome in yet another proceeding — a civil suit in which he was found liable for defaming the writer, E. Jean Carroll, who says he raped her in the early 1990s. And he’s had some success with the tactic, raising money and using the cases to stoke anger among his supporters. All of this, of course, has been a nightmare for the judges handling the proceedings who have had to deal with over-the-top legal briefs infused with political talking points — not to mention, in some instances, with threats from Trump and his followers. And that’s on top of the more ordinary challenge of trying to preserve an air of legal rectitude amid Trump’s ceaseless griping about witch hunts and unfairness. It acknowledged that the case “stands alone, in a unique place in this nation’s history,” but also seemed to rue the fact that Trump had asked for the postponement for political reasons and “a litany of perceived and unsubstantiated grievances.” Clinging to the notion that the courts should be a “fair, impartial, and apolitical institution,” Merchan made what seemed to be a pained decision to put off issuing the sentence, saying he had done so for a noble reason: to “avoid any appearance — however unwarranted — that the proceeding has been affected by or seeks to affect the approaching presidential election.” A swift schedule on the election case Judge Tanya Chutkan took a different tack in Washington yesterday when she [put aside the fact of the approaching election](~/AAAAAQA~/RgRoveyfP0TpaHR0cHM6Ly93d3cubnl0aW1lcy5jb20vMjAyNC8wOS8wNS91cy9wb2xpdGljcy90cnVtcC1lbGVjdGlvbi1jYXNlLWphbi02Lmh0bWw_Y2FtcGFpZ25faWQ9MzA1JmVtYz1lZGl0X3RvdF8yMDI0MDkwNiZpbnN0YW5jZV9pZD0xMzM2NTMmbmw9dHJ1bXAtb24tdHJpYWwmcmVnaV9pZD03NzY3NDk1MiZzZWdtZW50X2lkPTE3NzExMyZ0ZT0xJnVzZXJfaWQ9YWE0OTFlZjdmMWQ5NjRlNDk3OWZiNzg0ZTc0ZTAxZDdXA255dEIKZs-fZ9tmNv1yTVIbdHJpc3RyYW1iYWxkd2luOTBAZ21haWwuY29tWAQAAAAD). She moved speedily ahead with a filing schedule to determine the impact on Trump’s election interference case of the Supreme Court’s recent ruling granting him broad protections against prosecution for acts he took as president. The upshot of Chutkan’s deadlines was that prosecutors will be able to submit a lengthy filing to her by late September, detailing why they believe that Trump’s various plots to overturn his loss in 2020 should survive the Supreme Court’s ruling. That filing is likely to contain new evidence against Trump — including interviews with witnesses who were close to him — though it remains unclear how much of the material will be revealed in public or submitted under seal. The case is currently mired in an appeal of the trial judge’s decision not to disqualify Fani Willis, the district attorney who brought the charges last summer, because of a potential conflict arising from a romantic relationship she had with one of her deputies. And that’s just one of the legal obstacles impeding the case. When the disqualification issue is resolved, likely some time next year, the two sides will still have to fight over whether Trump can even be tried on the election tampering charges under the Supreme Court’s immunity decision.
