In his concurring opinion, Judge James Ho argued that doctors suffer “aesthetic injury from the destruction of unborn life.” And while the absurdity of the argument is clear, what was not made evident was the ties Judge Ho shared to the conservative group bringing forward the case. Per reporting from Jacobin and The Lever, the judge's wife had previously received payments from and participated in events with the Alliance Defending Freedom.
