When Ruth Bader Ginsburg died in September 2020, Senate Republicans rushed to replace her with Amy Coney Barrett, just weeks before the presidential election. You probably haven't forgotten how Mitch McConnell, then the Senate majority leader, sat on former President Obama's nomination of Merrick Garland for 293 days, ensuring that Antonin Scalia's seat was replaced by another conservative when Trump took office. So, Democrats, with their precarious hold on the Senate, need to act fast to fill Breyer's seat before the midterms if they want to hang onto their three-person minority in the nation's highest court.
