Connecticut, the court ruled that married people have a right to use contraception. That may not seem radical today, but it established the right to privacy—which gave rise to [later court decisions]( on the right for [unmarried people to use contraception]( without government interference; the [right to abortion]( (which was, of course, [overruled by the 2022 Dobbs decision](); and other rights, including [same-sex marriage](. But now, nearly six decades later, many of these rights are under threat from the right—despite the fact that 90 percent of American women [have used contraception](. You probably remember how, in his concurring opinion in the Dobbs case, Justice Clarence Thomas [called for the court to “reconsider” Griswold](—all but saying that they should upend the rulings establishing not just the right to contraception, but also the rights to marriage equality and intimate sexual relationships. And just two days prior to the Griswold anniversary last week, Senate Republicans [blocked]( a [bill]( that would have protected contraception access at the federal level, alleging it was a largely symbolic, and unnecessary, effort from Democrats. The facts, though, tell a different story: Research shows that contraception is [not equally available]( to everyone who needs or wants it, and experts have said they [fear Trump could ban contraception]( using a 19th-century obscenity law if he's re-elected.
