Breaking Updates Appeals Court Publicly Rebukes California Judge for Handcuffing 13-Year-Old Girl in Court In a rare instance of disciplinary action against a federal judge, [the Ninth Circuit Court of Appeals issued a public reprimand to Judge Roger Benitez](of San Diego for having a 13-year-old girl handcuffed during a court session. The incident occurred in February 2023 during a hearing in which her father was the defendant. Benitezâs actions were ostensibly aimed at ensuring the girl did not follow in his footsteps. The judicial panel condemned the judgeâs actions as âabusiveâ and âharassing.â [The transcript contained in the appeals courtâs decision notes]( that Mario Puente was in court for violating the terms of his supervised release. His lawyer âstated that she would be joining the recommendation from the probation office for a sentence of 10 months of detention followed by a termination of supervised release.â The attorney then noted that Puenteâs teenage daughter was in the courtroom. Judge Benitez asked if Puente had anything to say about the proceedings. The defendant said he wished to leave San Diego to get away from negative influence, and mentioned that his daughter had fallen into some of the same habits. Benitez proceeded to lecture the teenager about the mistakes her father made that placed him in his situation, and said if she isnât careful, she will âwind up in cuffs, and youâll find yourself right here where I put you a minute ago.â The panel stated that shackling a court spectator who was not engaged in threatening behavior âexceeds the authority of a district judge.â When asked by reporters about the courtâs ruling, Benitez said: âI respectfully disagree.â [As part of the disciplinary action, Benitez will not be allowed to take]( on any new criminal cases for three years. However, he had already moved to focusing mostly on civil cases. Families in Democrat-run Chicago hoping to enjoy a Cinco de Mayo parade will have to wait until next year â after the city canceled the festivities due to "gang violence." The Chicago Police Department (CPD) announced Sunday that the Cinco de Mayo Parade was canceled "out of an abundance of caution⦠to protect the safety of all in attendance, including families and children." Families were forced to pack up and head home after reports of large-scale fights in the area. Chicago is a mess. [The city has suffered from years, nay, decades of incompetent government,]( brought about mostly by the citizenry voting out one incompetent city official only to vote in an even less competent city official. What's worse is that Cook County and Chicago, as is the case in many blue states, essentially control the rest of the state politically--meaning that all of Illinois suffers under these incompetent politicians.
