The core issue is a 40-year-old legal doctrine referred to as “Chevron deference,” which calls for courts to [defer to agency expertise]( when regulations are expanded without input from Congress. During questioning Wednesday on fishing regulations, several of the more conservative justices indicated they would prefer agencies to have explicit Congressional approval before unilaterally expanding their oversight.
