The Sweepstakes begins at 12:00:01 a.m., Central Daylight Time on 12/22/2021, and ends at 11:59:59 p.m., Central Daylight Time on 1/1/2022 ("Sweepstakes Period"). 1. Eligibility: The Sweepstakes is open only to legal residents of the forty-eight (48) contiguous United States and District of Columbia who are eighteen (18) years of age (or the age of majority in their state of primary residence) or older as of the Sweepstakes start date. Void in Hawaii, Alaska, and where prohibited by law. How to Enter: Beginning at 12:00:01 a.m., Central Daylight Time on 12/22/2021 you may enter the Sweepstakes by clicking on the link emailed directly to specific Greyhound customers and answering all questions on Greyhound’s Travel Preference Survey (the “Survey”) including first name, last name, date of birth, complete address, phone number, and email address. You must complete and submit the Survey (or, each an “Entry”) with all required information for the entry to be eligible for the Sweepstakes. To submit an entry via mail, you must provide your first name, last name, date of birth, complete address, day & evening phone numbers, email address and mail in an envelope (packaged carefully so it won't be damaged) with proper postage affixed, to the following mailing address: Attn: “Greyhound Travel Preference Survey” 350 N St. Paul, Dallas TX 75201 Suite #1000. All mail-in entries must be postmarked by 1/1/2022 and received by 1/6/2022 and become the property of the Sponsor. - There is a limit of one (1) entry, per valid email address, per eligible person, per the duration of the Sweepstakes. - All entries must be received by 1/1/2022 at 11:59.59 p.m. Central Daylight Time. Multiple participants are not permitted to share the same email address. Any attempt by you to obtain more than one (1) entry per day by using multiple/different email addresses, identities, registrations or logins, or any other methods may void your entries and you may be disqualified. Use of any automated system to participate is prohibited and will void all entries by you. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Sponsor reserves the right to contact entrants whose email address is submitted as part of this Sweepstakes. Illegible and/or incomplete entries and entries submitted by you which do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Winner Selection & Notification: On or about 1/6/2022, Sponsor or an independent judging agency will select from all valid entries received one (1) Grand Prize winners (each, a “Prize Winner”) in a random drawing from among all eligible entries received in accordance with these Official Rules. Sponsor will have complete discretion over interpretation of the Official Rules, of administration of the Sweepstakes, and of selection of the Prize Winner(s). Decisions of the Sponsor as to the selection of the Prize Winner(s) will be final. Each Prize Winner will be contacted by email and/or phone in a commercially reasonable time after the drawing using the contact information provided in the online entry form and awarded the prize (subject to verification of eligibility and compliance with these Official Rules). If Sponsor is unable to contact a potential Prize Winner within five (5) days from the first notification attempt (of if the prize notification is returned as undeliverable), if a potential Prize Winner fails to complete and return all requested forms by the specified date, or if a potential Prize Winner fails to comply with any of the requirements, his/her prize will be forfeited and Sponsor may select an alternate potential Prize Winner (in Sponsor’s sole discretion) from all remaining eligible Sweepstakes entries received. Sponsor's decisions as to the administration and operation of the Sweepstakes and the selection of the potential prize winners is final and binding in all matters related to the Sweepstakes. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be your sole and exclusive remedy under such circumstances. The Sweepstakes Sponsor is not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winners, or if potential winner is a minor, for late, lost, misdirected, or unsuccessful efforts of potential winner to provide signed parental or guardian consent. 4. Verification of Potential Winners: ELIGIBILITY, AGE, IDENTITY, AND RESIDENCY OF POTENTIAL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION. SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. The award of a prize to a potential prize winner is contingent upon compliance with all terms and conditions of these Official Rules. Each potential Prize Winner will be required to sign an affidavit of eligibility and a liability/publicity release (except where prohibited) and return same, properly executed, within seven (7) days of issuance of prize notification in order to claim his/her prize. 5. Prizes: There will be 1 Grand Prize Winners of a One Thousand and no/100 ($1000.00) general use gift card, with the specific card determined by Sponsor in its sole discretion. All decisions by Sponsor as to prize winner and prizes are final. Approximate retail value (ARV) of all prizes awarded in this Sweepstakes: One Thousand United States Dollars ($1,000.00 USD). The Prize Winner(s) may be required to provide Sponsor with a valid social security number or tax identification number before the prize will be awarded for tax reporting purposes. Conditions of Participation; Release & Indemnification: By entering the Sweepstakes, you agree to release, discharge, indemnify and hold harmless the Released Parties from and against any and all claims, liability, loss, and damage arising in connection with your participation and/or entry in the Sweepstakes and/or your receipt or use of any prize awarded in this Sweepstakes or due to any injuries, damages or losses to any person (including death) or property of any kind sustained in connection with your participation in the Sweepstakes or from your acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that the Released Parties have not made and are not responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Subject to applicable law, Prize Winner(s) irrevocably grant the Sweepstakes Sponsor and each of their licensees, and its and their successors, assigns and sub-licensees the right and permission to use their name, voice, likeness and/or biographical material for advertising, promotional and/or publicity purposes in connection with the Sweepstakes, in all forms of media and by all manners (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration except for the awarding of the prize(s) to the Prize Winner(s). Prize Winner(s) acknowledge that Sweepstakes Sponsor is relying on the irrevocable, unconditional and perpetual nature of the grants of rights and releases herein (including, without limitation, regarding rights of publicity), and any interference by Prize Winner(s) therewith would cause Sweepstakes Sponsor, and its successors, licensees and assigns, irreparable (not compensable by money damages alone) and excessive damages and would be manifestly unfounded, such that Sweepstakes Sponsor shall be entitled to equitable and injunctive relief (with no obligation to post bind or surety or establish likelihood of success) in addition to remedies at law. 8. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes play, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. Disputes. ENTRANT AGREES THAT: (I) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES, OR ANY PRIZES AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (II) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES, OR ANY PRIZES AWARDED, SHALL BE RESOLVED EXCLUSIVELY BY THE UNITED STATES DISTRICT COURT OR THE APPROPRIATE DALLAS, TEXAS COURT LOCATED IN THE CITY OF DALLAS, TEXAS; (III) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED (IF ANY), INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES, BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; AND (IV) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES AND/OR ANY OTHER DAMAGES, (OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES), AND/OR ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. 9. Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of Texas, without giving effect to any conflict of law rules or provisions that would cause the application of any other state’s laws. 10. Miscellaneous: The invalidity or unenforceability of any provision of these Official Rules or the Affidavit will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Affidavit is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. When terms such as "may" are used in these Official Rules, Sponsor has sole and absolute discretion. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy related to Marketing Programs or terms of use on the survey and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion. 11. Entrant's Personal Information: All entries become the exclusive property of Sponsor and will not be acknowledged or returned. As permitted by law, each entrant agrees that personal information collected in connection with this Sweepstakes will be used by Sponsor to contact you regarding promotional updates; information; messages; and for other reasons via electronic and/or ordinary mail in compliance with Sponsor’s privacy practices. Without otherwise limiting the foregoing, any personal information supplied by a Sweepstakes entrant to Sponsor will be subject to Sponsor’s privacy policy posted at (“Privacy Policy”). By entering the Sweepstakes, each entrant grants Sponsor permission to share your email address and any other personally identifiable information with third parties for the purpose of the Sweepstakes administration and prize fulfillment. Sponsor will not sell, rent, transfer or otherwise disclose your personal data to any third party other than as described herein or in the Privacy Policy. 12.
