[Important Student Loan and Bankruptcy Updates]( With a few recent updates to student loans repayment and a possible huge change to the bankruptcy code, attorneys and borrowers alike are bound to have questions. Here's what you need to know. First, the student loan payment moratorium has been extended until [January 2022](. Originally introduced in March 2020, this policy pauses all debt collection efforts, required payments, and interest rates on federal student loans for more than 36 million borrowers. The Department of Education noted this will be the final extension. A landmark, bipartisan bill that aims to make it easier to discharge student loan debt in bankruptcy was also recently introduced in the Senate. [The Fresh Start through Bankruptcy Act of 2021]( would allow federal student loan borrowers to discharge their debt through bankruptcy without proving undue hardship, as long as their loans had been in repayment for at least 10 years. For privately held loans and those who have been in repayment for less than 10 years, the current undue hardship standard would be retained. If passed, this bill would drastically change how student loans are handled in bankruptcy and give borrowers an easier path to financial freedom.
