The test evaluates if there's an investment of money in a common enterprise with an expectation of profits primarily from the efforts of others. - Judge's Inquiry: Judge Katherine Polk Failla raised concerns about the broad application of the SEC's standard, questioning if it could extend to collectibles or commodities like Beanie Babies. 🏛️ The Beanie Baby Debate The SEC lawyer argued that collectibles, such as baseball cards, don't constitute a common enterprise. Their value is influenced by customer taste and time, not by a collective effort to increase their worth. The lawyer distinguished digital tokens from traditional collectibles, stating that tokens are integral to their respective crypto ecosystems and derive value from these networks. 💡 Ecosystems and Token Value In the SEC's view, digital tokens offer access to their specific crypto ecosystems.
