Until a nationwide constitutional solution is possible, we need to take this one state at a time. The good news is, the people are with us. Abortion rights have majority support across the country, even in red states. A recent study by the Public Religion Research Institute found that a majority of citizens in 43 states say abortion should be legal in most or all cases. In 13 states, abortion rights are favored by over 70% of voters. Wade’s reversal in 2022. They have voted against proposed state-level anti-abortion bans in Kansas, Kentucky, and Montana, and passed constitutional amendments to preserve abortion rights in California, Vermont, and Michigan. Now, voter initiatives protecting reproductive rights have already been placed on the ballot for 2024 in New York and Maryland, and efforts are underway in Florida and Ohio. Between potential voter initiatives and Democratic majority state legislatures, a recent analysis by Daily Kos identified 23 states, plus the District of Columbia, where there is sufficient voter support to enshrine abortion rights in state constitutions. Collectively, these states represent 58% of the U.S. population. We can ensure the majority of Americans enjoy constitutional protections for reproductive rights in their states, despite the machinations of the Trump-appointed U.S. Supreme Court.
