After Trump picked three of the nine Justices to a lifetime appointment, the Court's right-wing majority has made extreme decisions that are out of step with mainstream views—such as repealing Roe v. Wade. But this is more than ideology. The Supreme Court is in a crisis of confidence, with members of the Court defying conflict-of-interest standards. From Clarence Thomas accepting luxury gifts from a major Republican donor to John Roberts' wife recruiting lawyers for firms who have business before the Supreme Court, we can no longer trust that the Justices are being fair. Unlike most federal judges, the U.S. Supreme Court is not subject to a code of ethics that governs conflict-of-interest rules. Advocates have complained about this for years, but now we need action. There is a push in Congress to require some ethics at the Supreme Court. This exception has led to rampant, blatant conflicts of interest among some justices–with zero accountability. Moreover, the Supreme Court’s political rulings, which frequently contradict the public’s will, have caused further erosion of public trust. Decisions that undermine reproductive rights, dilute voting rights protections, overturn reasonable state and local gun regulations, and challenge federal efforts to combat climate change have deeply disappointed many Americans who expect the Court to uphold the principles of justice and fairness as opposed to partisan politics. We must restore transparency and accountability in the U.S. Supreme Court. We are calling on Congress to ensure that by passing the Supreme Court Ethics Act.
