Requiring a code of ethics for Supreme Court justices is not a new idea, as advocates have been pushing it for years. In 2019, Justice Elena Kagan [told Congress]( that an ethics code for the Supreme Court was "in the works." Nothing happened, and we are still waiting. Meanwhile, the credibility of the Supreme Court is in danger. Clarence Thomas' wife actively tried to overturn the 2020 presidential election, but he will not recuse himself on any matters relating to January 6th. And Samuel Alito is under fire for [having allegedly shared]( Supreme Court opinions with conservative activists before they were published. We cannot allow nine justices in robes make far-reaching decisions on our country, while they refuse to abide by legal and ethical requirements that every other judge must agree to. We cannot trust the Supreme Court to act, so Congress must pass a law requiring them to. The Supreme Court Ethics, Recusal, and Transparency Act, recently re-introduced in Congress, would directly address accountability and transparency at the Supreme Court. This legislation would require the creation of a code of ethical conduct for the U.S. Supreme Court, a requirement that justices to publicly disclose recusal decisions, and the appointment of an Ethics Investigations Counsel to oversee accountability. Supreme Court Justices must be held to account for flouting the ethical rules that apply to every other judge in the country.
