As in all states with total or near-total bans, Idaho’s law criminalizes doctors for performing life-saving procedures. That conflicts with a federal requirement to provide medical care when the pregnant person’s life is at stake. Suing Idaho is a good first step, but the Justice Department must do more. When federal and state law is in conflict, federal law prevails. The DOJ must use its power to challenge all state bans that violate federal law. If banning abortion is no longer unconstitutional, it is imperative that we use every method at our disposal to restore abortion access.
