Our lawmakers should utilize this time of remembrance to implement policies that can proactively prevent anything like the insurrectionâand the lack of accountability we all witnessed afterwardâfrom ever happening again. One such proposed policy is the Protecting Our Democracy Act, a legislative package of reforms that would hold powerful people responsible for actions that jeopardize our democracy. Among other measures, the bill would limit the presidentâs pardon power, boost enforcement of congressional subpoenas, and strengthen protections for inspectors general and federal whistleblowers, all of which could have made a world of difference during the Trump administration. One year is too long to wait for change after the very core of our democracy was shaken. Our senators must act now. A year ago, a sitting U.S President fomented an insurrection, inciting his supporters to storm the People's House. Now, as the congressional investigation into the insurrection continues, Trump has unleashed a torrent of litigation. He hopes to use executive privilege to sidestep inter-branch checks and balances and run out the clock on accountability and transparency. Executive privilege exists to promote efficiency, protect confidentiality, and enhance national security. However, the previous administration weaponized that privilege to delay and evade justice. We need better laws to prevent presidential abuse of power because no president should be above the law, no matter their party. The Protecting Our Democracy Act would restore accountability and transparency to the presidency by: - Limiting the president's pardon power.
- Enforcing the constitutional ban on presidents using the office to enrich themselves.
- Boosting enforcement of congressional subpoenas.
- Strengthening protections for inspectors general and federal whistleblowers.
- Bolstering enforcement of the Hatch Act.
- Preventing foreign interference in elections and clarifying federal prohibitions on foreign assistance to campaigns.
- Requiring transparency of tax records of presidential candidates, and more.
Executive privilege doesn't give presidents carte blanche for criminal activity. If they break the law, they must be prosecuted, and our government needs the tools to ensure that happens.
