As of March 11, there are 11 circuit court and 82 district court current and announced [vacancies](. That’s ninety-three opportunities to shape the future of our federal courts—and it’s crucial that they’re filled with diverse nominees. When judicial openings occur, U.S. senators recommend nominees to fill those seats. However, for far too long, the [vast majority]( of nominated judges have been former [corporate lawyers]( and prosecutors. In a time where we must prioritize restoring and expanding civil rights—and ensure representation of marginalized communities on the federal bench—this nomination norm must change. We must also nominate more women, people of color, disabled people, and LGBTQ+ people to the bench. These two goals go hand in hand: research [shows]( that professionally diverse nominees are less likely to be white and male than those from corporate backgrounds. Thankfully, President Biden and his team have also indicated that we need nominees who understand the legal needs of people who are historically underrepresented on the bench. In a December 2020 letter to U.S. senators, White House Counsel Dana Remus [explained]( that Biden is “eager to nominate individuals who reflect the best of America and who look like America.” Now, it’s up to U.S. senators to follow the Remus letter and recommend a diverse slate of nominees when vacancies arise in their home states.
