Friend, I have some bad news; this past week the Senate Judiciary Committee voted along party lines to advance Steven Menashi's nomination to the U.S. Court of Appeals for the 2nd Circuit. Menashi's background has been laced with xenophobic, racist and misogynistic writings. He has denounced women's marches against sexual assault. He has opposed the "radical abortion rights" that are codified in Roe v Wade. He has compared race data collection by colleges to Germany under Hitler. He claimed that a fraternity wasn't being racist when they threw a "ghetto party" where the white students wore afros and carried toy guns. Menashi is dangerous and a threat to our civil liberties. He is also woefully unqualified to sit on a court. He has never argued an appeal, nor made any oral arguments, he has never conducted a deposition. He has never tried a case. His confirmation for this lifetime appointment now moves on to the full Senate with Mitch McConnell expected to quickly schedule a vote. McConnell is fast-tracking this nomination so that senators don't have enough time to research Menashi's background, and Senate Republicans don't want progressive groups like Daily Kos to mount a campaign to stop his confirmation, because we can actually win. [Too late. When news broke about the Judiciary Committee's vote, our activism team quickly moved to start organizing the Daily Kos community to generate calls and letters to their senators to stop this nomination. We will do everything we can to stop Menashi from sitting on the bench. Will you support our efforts by giving $5 TODAY?]( Menashi even managed to anger Republican senators on the Judiciary Committee when he refused to answer questions about his work in the Trump White House. This included his work with Trump acolyte, Stephen Miller in molding immigration policy and his legal counsel work with Secretary of Education Betsy DeVos that led to the roll back of protections for survivors of sexual assault. Republican Sen. John Kennedy categorized his behavior during the questioning as "eclectic" and Sen. Lindsay Graham said "He’s written some really weird stuff… He’s different than I would have chosen." Those Republicans eventually gave into Trump and voted to advance. We are flooding senators' offices with calls demanding a NO vote on Menashi's nomination. We need to shore up the Democratic vote and pressure vulnerable Republicans. Sen. Susan Collins has already announced that she intends to vote NO on Menashi -- we need to make sure she keeps her word. And the handful of senators with elections in 2020, like Cory Gardner of Colorado and Jodi Ernst from Iowa, know that their future could rest on this vote. There are also the few Republicans that have occasionally bucked their party and Trump and voted NO; like Senators Lisa Murkowski, Mitt Romney and Tim Scott. Stopping Trump's nominees like Menashi might seem hopeless, but I assure you it most definitely is not. Even though Trump is nominating judges at a record pace, he also has a high rate of those judges being rejected by the Senate or voluntarily withdrawing their nomination. It will come down to the amount of grassroots pressure we can generate. At Daily Kos, we are really good at doing this.
