The Constitution requires that federal judges be nominated by the president - but as we’ve seen time and time again, President Trump continues to select nominees whose extreme views pose a threat to our communities and environment. He’s at it again, and the consequences could be dire. With a history of suing the EPA and attacking immigrant communities’ rights, Andrew Oldham, Trump’s nominee for the United States Court of Appeals for the Fifth Circuit, is unfit to serve as a federal judge. To have a healthy democracy, our judges must be fair, impartial, and able to serve as a check on other branches of government. There is simply too much at stake to let Trump continue to pack the courts with dangerous, anti-environment judges. If Trump appoints judges across the nation with extreme views that match his own, the system that evaluates and challenges his policies becomes nothing more than a wink and a nod. When this happens, we can expect polluters and industry to continue to benefit at the expense of our health and environment. As Deputy Solicitor General of Texas and General Counsel to Texas Governor Greg Abbott, Oldham has been at the forefront of Texas’s legal fights with the federal government over environmental protections and immigration. Oldham’s strong anti-environment and anti-immigrant record should immediately disqualify him from impartially serving as a federal judge. Oldham is so extreme that he not only disagreed with environmental regulations, he actually questioned the constitutionality of the EPA. Oldham worked closely with EPA Administrator Scott Pruitt back when he was the Attorney General of Oklahoma to sue the EPA to make it harder to implement Clean Air Act. Oldham has also advanced an agenda that attacked communities of color and young immigrants. During the Obama administration, Oldham submitted briefs against the implementation of the DACA program. In Texas, he actively worked to gut the Voting Rights Act and defended Texas’s controversial voter ID law, which a federal judge ruled was passed with the intent to discriminate against communities of color. It couldn’t be clearer: Oldham’s racist and anti-environment agenda has no place in our federal courts. That’s why we can’t let this nomination move forward without a fight. Just a few weeks ago we saw that when the Senate highlighted just how dangerous and unqualified Trump’s Veterans Affairs nominee was, it totally derailed his candidacy.
