Now, Brady’s legal team has made progress in fighting this dangerous decision. Brady joined Giffords, Everytown, March For Our Lives, and Team ENOUGH to support California Attorney General Xavier Becerra’s petition asking the 9th Circuit to rehear the case. Will you donate now so that we can continue to work to protects Californians and all Americans? >>]( The 9th Circuit’s decision is an alarming divergence from every other federal Courts of Appeals that has considered legislative bans on LCMs and found them constitutional in the face of Second Amendment challenges. The majority’s decision ignores the will of California’s voters on an issue that involves complex questions of public safety and, if upheld, would allow the gun industry, not voters, to decide what the Second Amendment does and does not protect. It is critical that we push back and now allow the gun industry to decide put us in danger. When used in an attack, firearms equipped with LCMs kill more people before the shooter can be subdued and those who survive suffer more serious injuries. More troublingly, decisions like this could lead to vast restrictions on which gun safety laws are permissible, potentially prohibiting bans on military-style assault weapons. On Friday, a three-judge panel of the 9th U.S. Circuit Court of Appeals ruled that California’s ban on high-capacity ammunition magazines was unconstitutional. We aren't surprised-- one of the justices who made this erroneous decision, appellate Judge Kenneth Lee, is an NRA-endorsed Trump appointee. [Our court system should be protecting Americans, not sacrificing our safety for the NRA's evil agenda.]( Let's be clear: Large-capacity magazines are only useful for mass killers. They allow killers to enact extreme amounts of harm in very little time. They are not necessary for legitimate gun users and the court should know better than to rescind their ban. And they are definitely not what the Framers intended when, in the days of muskets, they drafted the Second Amendment. They sought to protect "well-regulated militias," not mass killers. We cannot allow reckless judges to manipulate the Second Amendment to support their NRA-backed agenda. The court's decision has deadly consequences, and it could cause a dangerous domino effect across the country: The same faulty logic being misused in this case could be used by other judges to enshrine a "constitutional right" to assault weapons. And that could invalidate common-sense gun laws across the country. We cannot allow this to happen. Brady's legal team is already working to push for a review and reversal of the dangerous decision.
