User Conduct Clarifies that the Badoo Group does not conduct background checks on any users or attempt to verify the accuracy or truthfulness of any statements they may make. Release Provides a full release of Badoo Group’s liability for any claims or disputes that may arise between you and any other users of Badoo. Arbitration - Provides that any covered dispute, claim or request for relief between you and Badoo Group that cannot be resolved informally or in small claims court will be settled by binding arbitration rather than through court proceedings. - Provides for a waiver of jury trial rights and requires disputes to be resolved on an individual basis without participation in class action lawsuits or other representative proceedings. - Explains that certain claims, such as claims for injunctions to stop intellectual property infringement or claims filed in small claims court, are not required to be submitted to arbitration. - Explains how you may initiate an arbitration proceeding against Badoo Group, and the rules that will govern any such proceeding. - Provides that users who signed up before May 27, 2021 will have the option to opt out of the arbitration agreement by 30 days from May 28, 2021. To opt out of the arbitration agreement, you will need to provide your full name, Badoo username and the email address you used to set up your Badoo account (if any). Badoo retains this information to maintain accurate records of opt-out requests. This information is kept for no longer than necessary to allow for the defence of legal claims in accordance with applicable statutory limitation periods.
