[View it in your browser]( [Center for American Progress]( InProgress from the Center for American Progress The Supreme Court’s Assault on Government [Stone steps lead up to the front of the U.S. Supreme Court building.]( This week, the U.S. Supreme Court is hearing two key cases that, individually, would undermine core functions and operations of the federal government. Alongside [other cases coming this term]( the Supreme Court is poised to incapacitate the government's ability to deliver for the American people. Tuesday, February 20: Oral arguments for [Corner Post v. Board of Governors of the Federal Reserve]( will be heard by the court. This case could allow for unceasing litigation and near infinite attempts for monied interests to challenge regulations, ultimately taking away important protections for American families and checks that have kept corporations and bad actors in line for decades. Wednesday, February 21: Oral arguments in [Ohio v. Environmental Protection Agency (EPA)]( will address whether the court will stay the EPA’s “good neighbor plan” that limits the release of smog-forming pollution from upwind states. With this case, the radical right-wing Supreme Court could end the EPA’s long-held statutory authority to regulate air pollution nationwide and protect Americans from major polluters. Ultimately, these cases are just two in [a series of cases this term that would thwart the will of voters]( by grabbing power away from the elected branches of government and instead place them with unelected judges with lifetime tenure. In turn, the far-right justices on the court have become emboldened to put power over reason in their decisions, striking down bedrock protections for Americans. All could be at risk. It is critical that progressives make every effort to reestablish the courts as a bastion of justice and expanding rights for all Americans, rather than being beholden to right-wing and billionaire interests."
